Website hosting and domains.

1. WEBSITE HOSTING

1.1 WEBSPACE AND BANDWIDTH

All web accounts are set up with 100MB webspace allowance. This will be incrementally increased when required to the maximum 1000MB allowance. Should more space be required after this, additional fees will apply. Accounts all include a maximum of 125GB of bandwidth, if more than this is required additional fees will apply.

1.2 ILLEGAL ACTIVITY

Should the account be found to be used for hosting illegal activity, or content that could be interpreted to be offensive or inappropriate, then the account will either be suspended or immediately terminated. Oliver Newth Graphics can accept no responsibility for lost files.

1.3 BACKUPS

The client must make regular backups, as Oliver Newth Graphics can accept no responsibility for lost or damaged files. To find out how to do this, visit www.cpanel.net.

1.4 PAYMENTS

Renewals and payments must be paid within 28 days of the renewal date. Failure to pay within this time will result in suspension of the client's hosting account or immediate termination.

2. DOMAINS

2.1 DOMAIN PURCHASE

Domains are purchased either in the name of the client or in the name of Oliver Newth Graphics. The client must keep up requested payments for the domains in order to retain ownership of them.

2.2 DOMAIN PRICING

The price of renewal and purchasing a domain may rise from time to time due to reselling price raising. Oliver Newth Graphics does may not inform clients of the rise in price prior to the cost raising.

Design services. (charged hourly)

1. PROJECT DETAILS

1.1 PROJECT OUTLINE

The project must be detailed in written form, either my letter or email, prior to work being carried out.

1.2 PROJECT REQUIREMENTS

The client acknowledges that full access will need to be provided to Oliver Newth Graphics to access the files (via FTP) and administration privileges given to edit any dynamic websites that the designer will be working on. MySQL database may also be required. Any other requirements must be given by the client upon agreement.

1.3 DESIGN PROCESS

Design work is done either on an ad-hoc basis or through the following steps:

Stage A - Initial designs - Looking at various styles and layouts for the media.
Stage B - Revisions - With a design agreed, this is modified so it is how the CLIENT desires. Up to 3 revisions will be included.
Stage C - Implementation - The design is edited to the correct format and installed as required.
Stage D - Final modifications - Final changes are made before the project is classed as completed. Up to 3 modifications will be included.

2. PROJECT PAYMENT

2.1 PROJECT RATE

The rate quoted is fixed (in pounds per hour, unless otherwise stated) in relation to the described project and is inclusive of normal disbursements and expenses. Disbursements will be charged at cost + 15% (for example, printing, postage, etc.)

2.2 PAYMENT TERMS

Payments are requested in sums of £200, and must be paid within 28 days of request. Should the total amount outstanding remain under £200 for more than 28 days, Oliver Newth Graphics may request payment of this, to be paid within 28 days.

3. OWNERSHIP & COPYRIGHT

3.1 OWNERSHIP OF ARTWORK

The client agrees that the ownership of artwork will remain that of the designer, with full, unlimited use granted to the client. The client will be entitled to edit, manipulate or reproduce any designs with no consent required.

Should the client request originals of the designs, the designer reserves the right to charge an additional cost for the time required to transfer files to disk, media costs and delivery costs.

The designer retains ownership of all preliminary design work.

3.2 PROMOTIONAL COPIES

The designer reserves the right to use preliminary designs as well as samples of the completed project in the future for for uses including but not limited to marketing materials (including but not limited to the designer’s portfolio) and design competitions. The client may be requested to give up to 5 copies of the next print of any publications designed to the designer at no cost for use as part of their portfolio.

3.3 CREDIT LINE

The designer reserves the right to place a ‘Designed by’ message in the code of each page created, also stating information about the copyright of the design.

The designer will place a ‘Designed by Oliver Newth Graphics’ message at the bottom of each website page, linking to the designer’s website. The designer will also put a credit line at the end of the any printed materials, unless prior agreement has been made between the client and designer.

Design services. (lump sum)

A written contract must be signed for design services involving a lump sum.
